These Terms govern your access to, usage of all content, Products and Services available at the Highway Star Consulting, LLC website (the "Service") operated by Highway Star Consulting, LLC ("us", "we", or "our").
Your access to our services is subject to your acceptance, without modification, of all of the terms and conditions contained herein and all other operating rules and policies published and that may be published from time to time by us.
Please read the Agreement carefully before accessing or using our Services. By accessing or using any part of our Services, you agree to be bound by these Terms. If you do not agree to any part of the terms of the Agreement, then you may not access or use our Services.
Highway Star Consulting, LLC provides various digital marketing services, including but not limited to Search Engine Optimization (SEO), Pay-Per-Click (PPC) advertising, Social Media Marketing (SMM), content creation, and web design ("Services"). All services are detailed in a separate Statement of Work (SOW) or client agreement, which will outline specific deliverables, timelines, and fees.
Fees for Services are due as specified in the client agreement. Services are typically billed on a recurring monthly basis and are payable in advance. Late payments may result in suspension of services and/or late fees. All fees paid are non-refundable.
The client agrees to provide timely access to necessary resources, including but not limited to website backends, ad accounts, analytics platforms, and brand assets. Delays in providing these resources may impact project timelines and results. The client is responsible for the accuracy and legality of all provided materials.
Upon full payment, the client shall own the specific deliverables created by Highway Star Consulting, LLC as outlined in the SOW. However, Highway Star Consulting, LLC retains the right to use the work for promotional purposes and retains ownership of all pre-existing materials, proprietary tools, software, and strategies used in the provision of services.
Both parties agree to keep confidential all non-public information obtained during the course of the service agreement. This includes business strategies, financial data, customer lists, and campaign performance data. This obligation extends beyond the termination of the agreement.
Either party may terminate the agreement with 30 days written notice. We may terminate or suspend your access to all or any part of our Services at any time, with or without cause, with or without notice, effective immediately, for reasons including but not limited to a breach of these terms.
Our Services are provided "AS IS." and "AS AVAILABLE". Highway Star Consulting, LLC and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability and fitness for a particular purpose. While we strive to deliver excellent results, we do not guarantee specific outcomes such as search engine rankings, lead volume, or revenue increases, as these are subject to factors beyond our control.
In no event will Highway Star Consulting, LLC, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; or (iii) for interruption of use or loss or corruption of data.
Highway Star Consulting, LLC reserves the right, at our sole discretion, to modify or replace these Terms at any time. If we make material changes, we will provide at least 30 days notice before the changes take effect.
